Avatar Creator

The short version: you must be 18 or over. You own what you make, and you're responsible for how you use it. Don't use Avatar Creator to imitate real people, deceive anyone, or make sexual or harmful content. The service is in early access, so it may change, have limits, or go down.

1. Who we are

Avatar Creator (makeavatarapp.com) is run by [OPERATOR: your legal name or company] ("we", "us"). These terms are an agreement between you and us about your use of the service. By creating an account or using Avatar Creator, you agree to them.

2. Your account

3. What Avatar Creator does

Avatar Creator uses AI models from third parties (currently including OpenAI) to generate fictional people ("avatars"), their images and, later, videos. AI output can be unexpected, inaccurate, or similar to output created for other people. Review everything before you use it.

4. Acceptable use

You must not use Avatar Creator to create, or try to create:

Don't try to break, overload, scrape or get around the limits of the service, or resell access to it. We may refuse a request, remove content, or suspend accounts that break these rules.

5. Advertising and disclosure

If you use avatars in ads or sponsored content, you're responsible for following the advertising laws and platform rules that apply to you, including rules on disclosing AI-generated people and on testimonials (for example, those of the FTC in the US or the ASA in the UK). Don't use an avatar to give a fake customer review.

6. Your content

You keep whatever rights you have in what you type or upload ("inputs") and, as between you and us, you own the avatars and media generated for you ("outputs"), to the extent the law allows. Some countries don't grant copyright in AI-generated material, so we can't promise that outputs are protectable.

You give us permission to host, store, process and display your inputs and outputs only so we can run and improve the service for you, and to share them with the AI providers that generate them. We don't sell your content or use it in our own marketing without asking you.

7. Early access, limits and changes

Avatar Creator is in early access and is currently free to use. We set daily limits to keep costs under control, and we may change, add or remove features. When we introduce paid plans we'll tell you the price before you're charged, and you can choose whether to subscribe.

8. Ending things

You can delete your account at any time from Account › Privacy & data. This deletes your avatars and images. We may suspend or close accounts that break these terms or put the service or other people at risk.

9. Disclaimers and liability

The service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We aren't liable for indirect or consequential losses, or for lost profits, revenue or data. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and £100 (or the equivalent in your currency). Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer.

10. Changes to these terms

We may update these terms. If a change is significant, we'll tell you by email or in the app before it takes effect. Continuing to use Avatar Creator after that means you accept the new terms.

11. Law

These terms are governed by the laws of [JURISDICTION: e.g. England and Wales], and its courts have jurisdiction, except where the law of the country you live in gives you the right to bring a claim locally.
